Copyright at TWU - DRAFT POLICY

Canadian copyright for academics at TWU

Video/Movies in Class

Since the Copyright Act C-42 came into force in November 2012, the instructional use of
video for educational purposes at TWU has become much more straightforward.

Instructors or others authorized by TWU may show the following types of works in a
TWU classroom (physical or virtual), as long as the purpose is not-for-profit education or
training. The audience should be primarily TWU students, TWU instructors, or people
directly responsible for setting curriculum at TWU
. (section 29.5) To ensure that viewing is restricted to eligible audiences, video being used in virtual environments should be accessible only by students/staff/faculty who are logged in through Moodle or other course management system.

You may show:

  • a cinematographic work (video/DVD), as long as the copy was legally obtained,
and you do not need to circumvent a technological protection measure (digital lock)
to show the work. (section 29.5, d)
  • online videos such as those on YouTube as long as they meet these criteria:
    • the videos on the site do not appear to infringe the owners' copyright
    • the site does not have a clearly visible notice (not merely the copyright symbol) that prohibits educational use
    • you do not need to circumvent a technological protection measure (digital
      lock) to show the work
    • you attribute (if given) the author, performer, maker, or broadcaster.
      (section 30.04)
